1. The service
Focusplay provides web-based educational games, learner profiles, progress tools, rewards, collections, and related content for families and schools. Features may change as the service develops.
2. Adult authorization and child accounts
You must be legally able to enter an agreement to create a parent, teacher, school, or administrator account. Children should use only a learner profile created or authorized by a parent, guardian, teacher, school, or district.
If you add a child, you confirm that you are the child’s parent or guardian or otherwise have authority to authorize the child’s use. If you act for a school, you confirm that you have authority to accept applicable terms and provide or manage student information.
3. Account responsibilities
- Provide accurate adult account and school information.
- Protect passwords, class codes, picture passwords, and account access.
- Use separate learner profiles for different children.
- Notify Focusplay if you believe an account or class code has been misused.
- Do not attempt to access another learner’s records or another school’s workspace.
4. Acceptable use
You may not use Focusplay to:
- Break the law, harm another person, harass a learner, or upload unlawful or inappropriate material.
- Probe, disrupt, overload, reverse engineer, scrape at unreasonable volume, bypass security, or gain unauthorized access.
- Misrepresent your identity, authority, school relationship, or parental relationship.
- Copy, resell, sublicense, or commercially exploit the service or its content without written permission.
- Upload personal information about another child unless you are authorized to do so.
5. Learner-created content
Some activities may allow a learner to create a drawing or short explanation. The learner or account holder retains ownership of original content. You grant Focusplay a limited license to host, process, display, and delete that content only as needed to provide, secure, and support the service. Do not submit confidential, identifying, or inappropriate material.
6. Educational purpose
Focusplay is an educational practice tool. It is not medical, psychological, diagnostic, special-education, or professional treatment advice. Game scores do not diagnose a learning disability, attention disorder, or other condition. Parents and educators should use their own judgment and qualified professionals when making educational or health decisions.
7. Progress, rewards, and virtual items
Stars, gold, streaks, characters, pets, cards, and other virtual items have no cash value, are not transferable outside Focusplay, and may not be exchanged for money. We may correct balances caused by errors, abuse, or duplicate awards. Focusplay does not guarantee a particular learning outcome, score, reward, or uninterrupted streak.
8. Trials, paid plans, and schools
Available trials, seats, features, prices, and plan terms may be shown during signup or in a separate order or school agreement. A school agreement or signed order controls if it conflicts with these general Terms. We will provide any required payment and cancellation terms before charging an account.
9. Privacy and student records
Our Privacy Policy describes the information we collect and how it is used. Schools remain responsible for their own notices, consents, approvals, and educational-record obligations. Focusplay will use school-provided student information only to provide and support the educational service and as allowed by the applicable school agreement and law.
10. Intellectual property
Focusplay, its software, game designs, original characters, graphics, text, logos, and other service content are owned by Focusplay or its licensors and are protected by applicable intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable right to use the service for its intended educational purpose.
11. Suspension and termination
We may limit or suspend access when reasonably necessary to protect learners, accounts, the service, or legal rights; investigate abuse; or enforce these Terms. Adult account holders may stop using Focusplay and may request account deletion. Parents may delete a child profile through the available family controls.
12. Service availability and disclaimers
We work to keep Focusplay available and accurate, but the service may occasionally be unavailable, contain errors, or change. To the extent permitted by law, the service is provided “as is” and “as available” without warranties that it will be uninterrupted or meet every educational need. Nothing in these Terms limits rights that cannot lawfully be waived.
13. Limitation of liability
To the extent permitted by law, Focusplay will not be responsible for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Any limitations apply only to the extent allowed by applicable law and do not limit obligations in a separate signed school agreement.
14. Changes
We may update these Terms as the service changes. The updated date will appear above. We will provide additional notice to adult account holders when a material change requires it. Continued use after an effective update means acceptance, except where law requires a different form of consent.
